Real Estate Specialist Agreement

This Real Estate Expert Agreement ("Agreement") is entered into by and between https://antalyahome.com.tr/ ("Platform") and the real estate consultant/expert ("Expert")—who registers on the Platform to publish property portfolios and listings—for the purpose of defining the terms of the services provided via the Platform, as well as the mutual rights and obligations of the parties. 1. Parties and Purpose Platform: https://antalyahome.com.tr/ (Antalya Home) Expert: A certified or authorized real estate consultant who registers on the Platform to publish listings for real estate (residential properties for sale/rent, land, commercial properties, hotels, etc.). The purpose of this Agreement is to regulate the operational procedures, management panel rules, and the principles regarding commissions/service fees applicable to real estate sales, purchases, and rental transactions facilitated through the listings published by the Expert on the Platform. 2. Commission and Service Fee Commitment Acceptance of Commission: The Expert irrevocably accepts, declares, and undertakes to pay Antalya Home the commission (service fee)—as specified in the management panel and defined on a per-listing/portfolio basis—for all sales and rental transactions resulting from listings published on the Antalya Home platform, client referrals provided, or contacts established through the Platform. Timing of Payment: Upon the completion of a real estate sale (transfer of title deed) or rental transaction (signing of a lease agreement), the agreed-upon commission amount shall be transferred to the Antalya Home account within the payment timeframes specified in the management panel. Rate Changes: Commission rates and any updates thereto are announced via the Expert panel. The rates defined in the panel as of the date a listing is published or updated shall apply. 3. Listing Publication Policies and Accuracy Accurate and Up-to-Date Information: The Expert acknowledges that all listings uploaded to the Platform (including price, property status, images, square footage, and authorization documentation) must be accurate, current, and in compliance with applicable regulations (the Regulation on Real Estate Trade). Authorization Documentation: The Expert warrants that they have obtained the necessary marketing authorization from the property owner and possess all relevant legal documentation for the listings they publish. The Expert bears sole legal and criminal liability for any misleading, fraudulent, or unauthorized listings. 4. Service Disruption and Rights to Remove Listings Antalya Home reserves the right to suspend or remove listings, or to unilaterally terminate the membership account of any Expert who: Fails to fulfill commission payment obligations as specified in the management panel; Uploads listings containing misleading or incomplete information; or Engages in conduct that compromises customer satisfaction or the reputation of the Platform. 5. Confidentiality and Data Security The Expert undertakes to use customer information and inquiry details obtained through the Platform solely for the purpose of executing the relevant real estate transaction, in accordance with the provisions of the Personal Data Protection Law (KVKK) No. 6698, and agrees not to share such information with third parties. 6. Effectiveness and Acceptance By registering on the Antalya Home management panel, checking the confirmation box, or publishing their first listing on the Platform, the Expert shall be deemed to have read, understood, and unconditionally accepted all the terms of this agreement. 7. Competent Court The courts and enforcement offices of Antalya shall have jurisdiction over the resolution of any disputes that may arise from this agreement.
